In a stunning 6–3 decision, the Supreme Court of the United States ruled that President Donald Trump overstepped his authority by using the International Emergency Economic Powers Act to impose sweeping tariffs on China, Canada, Mexico, and other trading partners. The Court made it clear: emergency powers cannot be used to rewrite U.S. trade policy.
🚨 Translation? Trump’s signature economic weapon just hit a constitutional wall.
This ruling wipes out a massive portion of second-term tariffs — policies the Congressional Budget Office estimated could impact the economy by nearly $3 TRILLION over the next decade. The U.S. Treasury has already collected more than $133 billion from these import taxes.
Now the focus shifts to the $170 BILLION refund fight. Over 1,500 companies are lining up for potential repayments as the case heads back to the United States Court of International Trade. One justice warned the process could become a “mess.”
But here’s the twist: this may not be the end of tariffs — just the end of overnight tariff shocks. Trump still has multiple statutory pathways to rebuild parts of his tariff wall, though slower and more limited.
With average tariff rates jumping from 2% to over 15% — and possibly falling toward 6.5% — this ruling could reshape inflation, trade wars, and real incomes heading into 2026.
